Lawsuit filed against Kansas state for victimizing children under the guise of "Protection&quot

As many may already well know, over 11 months ago the state of Kansas has maintained physical custody Illegally over the 5 under age children of Raymond and Amelia Schwab, former residents of Colorado whom had relocated to Kansas state per Raymond's job with the Department of Veterans Affairs (VA) claiming that it was in the children's best interest, especially considering "Safety".

Grandma initially turned the children into the state declaring that the children had in fact been "Abandoned" by their parents which quickly proved to be un-true. Upon confrontation from state officials, grandma quickly admitted that it was un-true, and that ultimately she made that declaration because she was in fear for her grandchildren's safety and well-being. The state officials had been told by Raymond Schwab's mother-in-law that the children were being moved to "Live on a pot farm in Colorado" and that she was afraid for their safety because of that decision. Little did grandma know or even fathom at the time, that it would be her self-generated fear that would ultimately put her grandchildren in more danger than a state full of cannabis or even living on a "marijuana farm" would ever cause upon them.

Grandma of coarse has since More than apologized and regretted her irrational decision, but, unfortunately thanks to the states child protective services proticol in Kansas, the damage is not only far worse and deeper for these children... and it's guaranteed to leave permanent unfix-able wounds in all, especially their youngest and only daughter.

The Schwab’s received an email from state officials notifying them of their son’s glasses being broken in a fight with another child. The email stated that their son Caleb was actually punched in the face by another, but the family state that the tone of the email makes the incident seem as if nothing significant occurred other than just typical kids being kids, even referring to Caleb’s attacker as “kiddo.” There was no mention as to whether or not any repercussions befell their son's attacker or whether or not there were any additional sufferings from the incident, loving parents instinctual questions of coarse, but unanswered to.

The sad state of affairs for family Schwab thanks to Kansas state officials...

As if illegally ripping and then keeping kids from their homes and families is not bad enough, nor emotionally damaging enough to children, the loved ones of children victimized in these ways also suffer tremendously too, including elder siblings helplessly left to watch it happen. This situation we have here with the Schwab family beyond such traumatizing than wounds that deep alone... and far more horrifying for these poor children than Anyone could ever have fathomed.

The second alarming situation rocked through the Schwab family as a result of Kansas state officials, when they would come to learn that the couple’s oldest son presently in state custody because of all this, who Raymond is not the father of biologically by the way, was actually placed into his biological father’s care, despite Amelia arguing that he was a violent alcoholic. Once in his care, Deven was physically abused.

Since being removed from the Schwab’s custody, the children have fallen victim to far worse abuse than the State of Kansas ever accused the Schwabs of inflicting upon the children. At most, the state attempted to allege that because Raymond had served his country in the military and later received a diagnosis of PTSD for his honorable service, they believed Raymond may have been "Emotionally abusing" the children - allegations they ultimately confirmed they could not substantiate. And just when one would think there might possibly be some room for justifiable concern regarding the safety of the children being in state care...

Another email was received by Raymond and Amelia Schwab from a lady named Deja Jackson, whom works for the state at "KVC", regarding another of their son's named Caleb, informing them that Caleb has been placed into "Pathways Psychiatric Residential Treatment Facility" because he was declared "Mentally ill" for having displayed separation anxiety due to the states intervention dividing him from his family. He is being given many "mental health" medications- a decision made Without the families input, and ultimately Against the families as well as the childrens Power of Attorney's belief systems.

Now obviously intensely worrying about their children, not understanding why despite no grounds or room for reason nor question about their right, ability and desire to resume raising their children themselves, Raymond and his wife were then notified by the state that their worst fear and nightmare as parents has actually come true... their only baby girl, adorable little 5-year-old... they were told, "had a substantiated hotline report for sexual abuse."

Please keep in mind, this abuse did NOT happen to either child while in their Parents care, but instead while they were in the state of Kansas's "Child protective services custody."

Immediately of coarse, Mr. & Mrs. Schwab began demanding as well as even begging and pleading for their children to Immediately be returned to their safe care, but despite all of this, still they are deprived of any interaction with their children and their cries went unacknowledged. Social workers have stated to inquiring persons, that this is the first time they have ever seen children "Taken without an investigation First" and off-record note it is semingly an odd situation going on regarding the Schwab children indeed, but despite that, and all the hoops that the parents have had to successfully jump through in effort of getting their kids back, all of which they DID mind you, and iced with the factual frosting being the fact that the states own "investigation" has concluded that there is no legally conclusive reason for the children to remain in state control, they still do, are and too, are suffering... emotionally as well as physically and now as the family would come to learn... Sexually.

An ironic discovery made while researching into this situation revealed that 96% of children currently in state custody are "Unsubstantiated" throughout the state of Kansas- WOW... that speaks such volumes. Now, below we will look at the brief response that Kansas state officials have to say about it in attempt of validating their reasoning:

You will note this speaker, Phyllis Gilmore, a state social worker in a wheelchair, quick to defend their "Obligation to protect children" as the states "Child welfare safety office", and interestingly, bring up a young infants death she claims is a result of "the FOSTER parents" leaving the 10 month old child strapped in a car seat while they were inside the home getting high on marijuana." She goes onto claim that "19% of children removed because of drug use, and that's not counting methamphetamine abuse." The lady bases her position on the propiganda that "Marijuana is a gateway drug" which obviously she is unaware of the Institute of Medicines medical and scientific conclusion that cannabis is far from a gateway drug.

Perhaps Ms. Gilmore is unaware of the 4 year old boy named Mekhi Boone, whom was beaten to literal death, on top of having been sexually abused while in their states custody all at the hands of "Foster parents" entrusted other peoples children by the decision of state officials just one year ago... just about the time Kansas state then chose to steal the Schwab children. If you look at the link below, you will find a little year old boy who was also taken into their "Protective SERVICE" and was beaten, ultimately to literal Death just one year ago, on top of having also been sexually abused while in the states "protective custody" as well, look for yourself:

"Protective custody", so they claim... but is their protection "Safe" for the Children is the question needing answered to.

In short, Oklevueha Native American Church (ONAC) and our attorney Matthew Pappas are going to be tolerant no more to this or any state Victimizing families and especially children under the guise of "Protecting" children from "Cannabis". As you saw in the first link above, Matthew Pappas explained that a lawsuit and injunction has been officially filed upon the state of Kansas on behalf of the family. Matt is the lead attorney for ONAC to which the family are honorable members in Good Standing therein.

Turning of the tides...

One of the facts that the state has yet to acknowledge in regards to this situation, is that they have not just stolen and now victimized Any average child... these children are half Chippewa tribal nation blookline, which in turn means that the state has violated federal law by removing the children from the family period. They have further violated their rights and federal law by Separating the children from one another as they have, especially by putting young Caleb into a mental institution!

While Pappas was preparing the documents for filing, David Gaskin, CEO of ONAC Indigenous Peoples Church of Sugar Island was dispatched to the scene upon learning that Raymond Schwab had been arrested during his hunger strike protest in efort of bringing public attention to his families situation and victimization by the state of Kansas. He had been warned the day before that should he return to continue the protest he would be arrested, which he did and ultimately was within moments of his arrival to the state capitol building on day 11 of his protest. Gaskin is the International tribal chief of the Ojibwe Chippewa tribes, his grandmother actually formally establishing the Chippewa nation at a tribe in North America.

Gaskin's mere physical presence, along with his wisdom of the laws - especially regarding children like these with tribal bloodline, quickly made a huge and scary impact on Kansas state officials, whom, by the time Pappas arrived to file suit was informed that the state is now suddenly willing to try and back-peddle their way out of this disastrous situation they have illegally caused the Schwab family.

The suit was filed on March 31st, 2016, prepared by ONAC's lead Civil Rights attorney Matthew Pappas.

Kansas state back-peddles their way out of their illegally mucked waters...

As of now, the state of Kansas has agreed to release the Schwab children to the Chippewa tribal nation. The tribe is in process of making this happen as swiftly as is possible and we will keep you informed as we get word of any progress.
