Native American Church Hawaii (NAC HI) shot down in federal court for fed-ex sacrament seizure case
Word is out, that Michael Rex 'Raging Bear' Mooney's newly self-established 'Native American Church Hawaii', or, (NAC HI) will Not be getting "Relief" from the federal government for their sacrament seized by Fed-Ex back in 2009 when he was protected under Oklevueha Native American Church.
At the time of the incident, 'Raging Bear' was in fact a bona-fide independent branch of Oklevueha Native American Church known as ONACHI and was personally in Good Standing with the whole of ONAC, but having since fallen from Good Standing and ultimately into out-right excommunication from the "Mother Church" Oklevueha Native American Church (ONAC), Mooney elected to venture out on his own and create his Own church, dropped the Oklevueha name, logos and insignia's, and obtained his own EIN number from the federal government officially recognizing he as founder of Native American Church Hawaii, or "NAC HI" as he prefers it called and publicly known.

Oklevueha Native American Church (ONAC) has obtained legal right to utilize "All Earth-Based Healing Sacraments" in state supreme courts that have in turn been honored and upheld in various state courtrooms as well... but then again, ONAC has long been issued a "Schedule 1 Controlled Substance "Exemption" identification number from the Drug Enforcement Agency in addition to being the only church bona-fide in the land for meeting all 14 of the IRS / Federal Governments Standard system.. credentials and protections ONAC say Raging Bear lost when he was officially booted from the "Mother"church.
In December of 2015, after it became known to federal officials that Michael Rex 'Raging Bear' Mooney and his NAC HI were no longer part of nor protected by ONAC, the 9th court recalled the case at which time attorney for NAC HI, Michael Glen testified in Mooney's absence that "Cannabis is a generic substitute" for the peyote sacrament when NAC HI cannot obtain peyote sacrament needed for ceremony... a practice no other Native American Church does and Oklevueha specifically does not revere cannabis as a "generic" or substitute for ANY sacred sacrament... that it in fact is "name brand quality" all on it's own and has it's proper place in ceremony.
"Cannabis most definitely IS a sacred plant substance, or "Sacrament" gifted us by Great Creator and Mother Earth, it is our Mother Medicine, but, it is Not generic in any fashion, nor do we use or teach To use it as a substitute for Any Other sacred substances during ceremonies encompassing other specific medicines, and we feel it's an important and distinct difference in the practices of Oklevueha Native American Churches globally and NAC HI needing to be emphasized for the sake of official record" said Sachem Joy Graves. "NAC HI is Not a part of nor protected by or as Oklevueha Native American Church, nor do they operate or teach in any way as we do when it comes to sacraments and ceremony, and therefore obviously as seen here, are not entitled to the protections we are as ONAC."
Here nor there, the bottom line is that the 9th has finally formally decided that Michael Mooney nor his NAC HI are exempt from prosecution for transporting cannabis sacrament, nor will they be getting compensated for that which they had seized back in 2009, plain and simple.
