ONAC KM President struggles for court defense counsel
It is with great frustration that the Oregon justice system seems to have such the hard time providing defendants with adequate court-appointed counsel as obligated to do according to law, but as time and victimization on Oklevueha members continue, it becomes more apparent that they are struggling more than they should, and at the expense of not only their clients, but at the overall justice in the Oregon court systems.
An Oregon state BAR complaint has had to be filed by ONAC KM Church President Timothy Timm against court-appointed counsel Ms. Lisa Janoski noting dereliction of duty on her part in properly assisting in the preparing of Mr. Timm's defense regarding two pending cases before the Douglas County Oregon Circuit Court.
Mr. Timm alleges that Ms. Janoski would not provide him with a "Complete Copy" of the Discovery of evidence intended to be used against him in court, something every defendant is entitled to have and too, something to be obtained and then provided to the defendant in such a situation.
Within days of Timm's filing with the State BAR, he received a formal letter from a new attorney whom works for the same company contracted with Douglas County to represent defendant clients stating that Ms. Janoski has "been relocated" and that this new guy, Xavier OMoroney will be taking over representation for Timm on both cases. Timm states that this is not the first time he has had issues regarding the quality of effort put forth by the staff at Unpqua Public Defender, the company contracted as court-appointed representative counsel and reflects a case in 2014-2015 where he had to file another similar complaint against an attorney named Ms. Emily Apel who also appeared to Timm as "derelecting" in her efforts of properly preparing him a defense in a petty theft case, and that because of it, and the court not replacing Ms. Apel, he ultimately believed he was left with no choice but to accept a plea deal despite being 100% innocent of the allegations to which he was facing. Consequently Ms. Apel was "relocated" after that complaint to the Public Defenders of Marion County Inc.
