ONAC KM President to file Another BAR complaint against court appointed counsel
It seems to be becoming a regular pattern these days, as Oklevueha members of Kautantowit's Mecautea struggle to receive adequate defense counsel in the courtrooms of the state find themselves having to file formal complaints against attorneys for not putting forth effort in their job. "Our nation is in distress and especially so is our criminal justice system, in Oregon and across our land".
Just over one month ago, church president Timothy Timm found himself having to file a formal complaint against court-appointed counsel Ms. Lisa Janoski for not doing her job in the aiding of preparing his defense. To the churches surprise, the company in which the attorney worked for "Umpqua Valley Public Defender" (Inc.) who is contracted to provide court appointed legal representation to defendants under the Miranda law "relocated" Ms. Janoski and sent word to Timm that they were assigning him replacement counsel from among their staff.
One would Think that a formal complaint with the BAR would have created a "Conflict of interest", meaning that the companies employees in good conscious could not represent Timm, as most other filings of this sort found that answer to be the case, however, apparently it' not for this company.
Here nor there, the bottom line remains that now 2 attorneys from the company now have formal BAR complaints filed against the, leaving Timm and his two pending cases in somewhat of a legal limbo. In addition to Timm still Not being given a complete copy of the Discovery evidence intended to be used against him despite many months of begging and pleading for it, this complaint also lists reasons including Ignoring correspondence attempts made by Timm, ignoring instructions on plea entry positions, and failing to put forth notable effort to attain evidence Timm and the church believes would greatly benefit the preparation of his pending cases.
Timm, when asked expressed great concern over the situation and says that He believes it's due to prejudice against the church as a whole saying that there is "No way I can be properly ready for trial in under a month when not only do I not have their discovery evidence, but too, that I have no attorney willing to obtain the information and evidence pertaining to the cases I need and am entitled to."
Oklevueha leaders agree that at least in one of the two pending cases against Timm, a Religious Defense "is applicable and should have been presented to the courts months ago." They too concur that this situation "does further prove prejudice against the position of Oklevueha Native American Church as a front-line defender of Human Rights.
Members say that legal retaliation began within mere Hours of the church filing an Injunction in federal court back in January of this year, an injunction in which church leaders insist was not properly constructed or executed and ultimately stalled the case out in federal court and still continues to occur un-justly against members.
Church leaders further say that the folly happened due to inefficient church legal counsel, but that despite it, that Oklevueha is preparing to re-file an injunction in federal court in the hopes of permanently preventing such prejudice from endangering and victimizing other church members.
