Forchion refuses deal and wins case
It is always our great pleasure to bring you such news as victory against the criminal justice system, especially when it's a dear friend who succeeds at it.
On Feb. 3rd 2018 is when word walked into the jailhouse informing Robert Edward Forchion Jr. that the Trenton Municipal Prosecutors Office offered a plea deal. The deal offered was I would plead guilty to 1 of the 30 tickets issued to me in 2016 by the Trenton Police for violating statute 146-22.(hours of operation).
This situation arose when police insisted that his restaurant "The Weedmans Joint" was told they could not stay open nor cook chicken wings after 11Pm though the factual reality was always that while in a commercial zone Forchion and his joint could operate when and how they wanted to.
Forchion and many of his supporters believe that the municipal tickets were the catalyst that led to the raid on his restaurant and his subsequent arrest, which later led to witness tampering charges - the case for which he remains jailed despite being found Not Guilty on the 2nd degree count and hung the jury on a 3rd degree account.
According to Forchion: "#NOCHICKENWINGSAFTER11PM We created this hashtag to bring light to this situation that the police were ordering us to illegally close after 11pm. I filed a Federal Lawsuit about this the police retaliated & hired the R.A.T to entrap me in a crime they created (4/27/16). When I complained about that entrapment & exposed the R.A.T I was falsely charged with Witness Tampering."
Naturally Forchion Rejected the deal along with his answer, which was to to tell the city prosecutor to "kiss my yellow ass". So, ON February 6th 2018 which was a TUESDAY and coincidently too it was Bob Marley's Birthday, Forchion appeared in court at 1pm to stand against a total of 30 tickets. The case was heard in Coutroom A of the TRENTON MUNICIPAL COURT 225 N.CLINTON AVE TRENTON NJ .
As the case proceeded, it was music to the ears of man when the judge openly stated on the official court record " "Yes you could Stay Open After 11pm" and sub-sequentially Trenton Municipal Court Judge Gregory Williams agreed that Forchion's businesses were not considered a residential building, and dropped 13 of the 22 police lodged against Forchion or his business. The remaining nine tickets, for various other violations, will be discussed in a municipal court hearing in March.
Unfortunately however, Forchion still remains in custody as of this time meaning he remains a political prisoner on the grounds of "Witness Tampering" according to the official record despite him having been found not guilty on one count of witness tampering, but faced a hung jury on the second count, in November 2017. His retrial is pending and Forchion remains in jail.
