KM HQ- 11/11/2020
As many of you well know, KM ha ve been fighting for preservation and proper respects of our rights and good medicine efforts for the whole of mother globe at the federal level for quite some time now, several years and multiple case filings... which has not been an easy battle as a non-profit and non-501(c)(3) FREE church who has and continues to strive as a vow of poverty church.
The first filing in federal district court in Oregon was in January of 2016, when our then "sibling church" under confederation promised providing BAR licensed legal counsel for the case but ultimately the attorney they retained proved to be as big of a snake as our cannabis community and especially this "New industry" encompassing our beloved cannabis are infested with, and subsequently because his efforts were half-assed, the judge said on record, he had "no choice" but to dismiss the case because it was improperly prepared and certificate of service improperly executed by that proclaimed attorney team.
Of course our sibling church apologized profusely and Assured KM they would provide a new and more honorable attorney to represent the case, a promise that continued on to and even beyond what KM believed to be the statute of limitation deadline for re-filing, and so as that percieved deadline neared, KM went ahead and refiled and re-structured the core of the case to the best of our limited and lament ability back into the 9th District courts in Oregon, but because no BAR licensed attorney signed onto the case, once again the case was dismissed, this time due to lack of BAR representation for he church which was presumed to be a 501(c)(3) organization which would have funds to secure a BAR licensed attorney. However because KM is NOT and not about profiteering and in turn is NOT a 501(c)(3) tax exempt organization, have no bank account or options of donating or financially contributing to the church or it's causes, and do not have member stock options, legally an exception to that requirement for the church should be made and the case heard and judged by it's merit opposed to disregarded due to lack of financial means, but ultimately once again the case was dismissed without consideration or an opportunity of being officially heard on court record.
At that point, and too, under the perception that the grounds for the original filing, which encompassed an illegal theft of a church care package illegally stolen by a Portland, Oregon post office which subsequently resulted in irreparable harm including the literal death of the church member's recipient and ultimately too, the destruction of the poor woman's family thereafter, had expired as far as accountability under statute of limitations, KM leaders were devastated and heart-broken and felt helpless and powerless in as far as beneficially protecting and preserving church members and their individual as well as collective rights and liberties, and had given up hope of obtaining legal remedy or respect at all, the state's victimization continued to flourish fueled by their bias hate for the church and profile targeting church officers and members.
By fall of 2018 the retaliatory victimization upon the church expanded into the revealing of multiple conspiracies on the state's law enforcement officer's (LEO's) part ranging from conspiracy to deprive church and members of their rights, conspiracy to seriously harm/injure persons just because their church members, even a conspiracy to "KILL" upon the mere sight of key essential officer members.- and criminal actions persisted by the state of Oregon upon KM Church, leaving it's leaders no choice but to again file a federal claim in District court in effort of protecting and saving lives of church members.
For the third time a case was filed, and for the second time, despite sibling promises, the case was filed Pro Se in November 2019, but again, because there was no BAR licensed counsel to represent the church "entity" the church was "stricken from the case" as primary plaintiff and subsequently thereafter, the remaining plaintiff's were deprived of their right to assert the Religious Freedom Restoration Ac (RFRA) of 1996 affirming their victimization stemmed from bias religious discrimination and ultimately yet again, costing KM the right to have their case heard and their individual and collective rights protected.
But KM are WARRIORS and perhaps it's time they realize that as warriors KM and it's members will NOT give up until justice is preserved of it's integrity by and for the people of our nation.
According to all written man-derived "laws", all churches are to be protected by and from "state" meaning government, that they are not to infringe, hinder or burden in any fashion any church without first being able to Prove they meet a "compelling government interest standard" which 9 times out of 10 at least, they Know they simply cannot justifying having the right or ability to do. When they do, it's the federal government and in KM's opinion "If any, the US Supreme Courts Obligation to hear and judge our case and protect our church as assured in the very First Amendment of the Constitution of the continental United States." KM leaders remain frustrated in this intentional dereliction and lack of due process and proper justice and after the third dismissal are left with the feeling of hopelessness and helplessness when it comes to heir "Creator obligated tasks of protecting our rights, liberties, people and planet".
Despite these feelings however, KM assures it's members, confederated associates and community supporters that it has no intention of giving up the fight even despite such derivations including the lacking of ability to secure BAR licensed counsel and that the cases are again in process of being re-filed and that this time attached will be a bill for "in excess of 50 Million Dollars" for the damages KM victims have suffered "as deemed appropriate by the court." Spokespersons for KM say that "Though this is not about money but rights and principle, perhaps hitting them where it hurts them will get their attention and help them to realize that we are taking these criminal atrocities on their par Very seriously and that we wan them immediately stopped once and for all, period- we wan and demand our rights, members and creeds be respected and will no longer tolerate any less from them."
